In addition, you confirm that you have a personal bona fide interest in buying, selling, or leasing a residential property – the Site may not be used for any commercial purpose or any other non-personal purpose. If you do not agree to comply with the Agreement, you may not use the Site or subscribe to email services from Anote, and you are advised to leave the site immediately. The Site provides real estate related information to consumers and promotes and delivers services offered by Anot. The information provided on the Site is from sources we consider reliable, but because it is sometimes supplied by third parties, we cannot guarantee that it is accurate or complete and it should not be relied upon as such.

All Content posted on or through this Site, remains the valuable intellectual property of its owner(s), and is made available on or through the Site solely for your own personal, non-commercial, lawful use. You agree to abide by all copyright notices, information and restrictions contained in or displayed herein and with any Content.

You agree not to copy, redistribute or retransmit any of the data or information provided.
You acknowledge the Board/Association ownership of and the validity of the copyright in the designated database.
You consent to the fact that your Personal Information, including first and last name, email address, and phone number may be collected, used or disclosed.

To protect our Services, you agree to refrain from the following prohibited activites:

reproduction, distribution or use of the content, in whole or in part, is specifically prohibited. You will not, directly or indirectly, display, post, disseminate, distribute, publish, broadcast, transfer, sell or sublicense any Listing Information to another individual or entity.

Legal Capacity

Web sites accessed via links or other means from the Site have, unless otherwise indicated, been independently developed by third parties. The inclusion of any Content or links on the Site should not be construed as an express nor an implied endorsement of any third party products or services by us. Security

We use your data to provide our services to you. Our Privacy notice is an integral part of these terms and describes in more detail how we deal with personal data such as your name and email address.

When you enter or upload your data into our services, we don’t own that data but you grant us a license to use, copy, transmit, store, analyze, and back up all data you submit to us through our services, including personal data of yourself and others, to: enable you to use our services; allow us to improve, develop and protect our services; create new services; communicate with you about your subscription; and send you information we think may be of interest to you based on your marketing preferences.

Confidential Information refers to any information disclosed by a Party to the other Party or to which the receiving Party has access under this Agreement that is not publicly known or in respect of which the disclosing Party owes an obligation of confidence to a third party, including without limitation, any and all data and information relating to us, the business methods and strategies of the Service Provider, any personal data supplied by you.

While using our services, you may share confidential information with us, and you may become aware of confidential information about us. You and we both agree to take reasonable steps to protect the other party’s confidential information from being accessed by unauthorized individuals. You or we may share each other’s confidential information with legal or regulatory authorities if required to do so.

Termination

Without prejudice to our rights under these terms, this Agreement shall continue indefinitely until terminated by you or us pursuant to the provisions hereof or in accordance with the applicable law. We may discontinue, or terminate your access to, the Site or any portion of the Site, at any time without notice to you. Our discontinuance of the Site or any portion of the Site may result in the removal or deletion of Content made available by you. You are responsible for maintaining any required back up copies of such Content. Anot will not be liable to you with respect to its deletion of any Content.

Disclaimer

Anot, its affiliates, licensors and related companies, and each of their respective directors, officers, employees, consultants and agents expressly disclaim any and all representations, warranties and conditions, express and implied, including, without limitation, any and all representations and warranties of title and non-infringement, and all implied warranties and conditions of merchantable quality, fitness for any particular purpose, suitability for any particular purpose, and any representations, warranties or conditions arising from any course of dealing or usage of trade, with respect to the site or the content contained in or accessed through the site. neither Anot nor its affiliates, licensors and related companies, nor each of their respective directors, officers, employees, consultants and agents makes any representations or warranties as to the accuracy, timeliness, reliability, truthfulness or completeness of the site or the content contained in or accessed through the site, including, but not limited to, the contents of any content, information, material, or posting found on the site (including, but not limited to, any press releases or financial information), any services provided through the site, or any links to other sites made available on the site or the content contained on such site(s), or as to the continuous or error free use and operation of the site. Neither Anot nor its affiliates, licensors and related companies, nor each of their respective directors, officers, employees, consultants or agents makes any representations or warranties that the site or access to and use of the site will be uninterrupted, error free, or free from defects, viruses or other harmful components. you expressly agree that use of the site is at your sole risk.

Limitation of Liability

Under no circumstances, including, but not limited to, negligence, gross negligence, negligent misrepresentation and fundamental breach shall Anot or its affiliates, licensors and related companies, and each of their respective directors, officers, employees, consultants and agents be liable for any direct, indirect, incidental, special or consequential damages or any loss that result from your use of, or your inability to use, any content, information, material, or postings on the site, directly or indirectly. these limitations apply regardless of whether the party liable or allegedly liable was advised, had other reason to know, or in fact knew of the possibility of such damages. You specifically acknowledge and agree that neither Anot nor its affiliates, licensors and related companies, nor each of their respective directors, officers, employees, consultants and agents shall be liable for any defamatory, offensive or illegal conduct of any user, including you.

Indemnification

To the maximum extent permitted by applicable law, you will defend, indemnify and hold harmless Anot, its affiliates, licensors and related companies, and each of their respective directors, officers, employees, consultants and agents from and against all claims, liability, and expenses, including all legal fees and costs, arising out of: (a) your breach of any provision of this Agreement; or (b) your use of the Site, the Content , your contributions and the placement or transmission of any Content or any of your contributions on the Site made by you or others using your user name and password. Anot reserves the right, in its sole discretion and at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and you shall not in any event settle any matter without the prior written consent of Anot or its affiliates, licensors or related companies. You will co-operate as fully as reasonably required in the defense of any claim.

Miscellaneous

These terms are applicable to any and all order you place through our website and/or any and all services we provide to you. It is pertinent to note that by obtaining any of our services, you will be bound by the terms. Therefore, please make sure to read all the terms prior to placing an order. Once you have placed an order, it will be deemed as if you had read all the terms and accepted them with full knowledge.

This Agreement contains all the terms agreed between the parties regarding its subject matter and supersedes any prior agreement, understanding or arrangement between the parties, whether oral or in writing. Neither party shall have any remedy in respect of any untrue statement made by the other upon which that party relied in entering into this Agreement (unless such untrue statement was made fraudulently) and that party's only remedies shall be for breach of contract as provided in this Agreement.

We may need to update these terms and conditions at any time without prior notice. An updated term will have effect immediately.

Any disputes arising hereunder shall be governed exclusively by the laws of the province of (please insert province name) and the laws of Canada applicable therein, without giving effect to their conflict of laws principles. This Agreement has been drawn up in the English language at the express request of the parties.

If any term of this Agreement is to any extent illegal, otherwise invalid, or incapable of being enforced, such term shall be excluded to the extent of such invalidity or unenforceability; all other terms hereof shall remain in full force and effect; and, to the extent permitted and possible, the invalid or unenforceable term shall be deemed replaced by a term that is valid and enforceable and that comes closest to expressing the intention of such invalid or

unenforceable term.
